December Indictments Include Assault, Burglary And Imprisonment

The Grand Jury handed up indictments last week on charges including assault, burglary and unlawful imprisonment.
ASSAULT
• Kadesha A. Burch, 30, of 771 Perryville Road, has been indicted on a charge of 2nd degree assault, a class C felony.
On or about the Oct. 5, 2024, in Mercer County, Burch is alleged to have intentionally caused physical injury to the victim by shooting him with a gun, according to the indictment. Bail was set at $10,000. Patrolman Austin Price (HPD) testified.
• Aubrey J. Smith, 37, of 315 James Street, was indicted on two class B felonies, 1st degree assault (two counts), 1st degree trafficking in methamphetamine, a class C felony, and driving under the influence of a controlled substance, a class B misdemeanor. On or about Aug. 24, 2024, in Mercer County, Smith is alleged to have wantonly engaged in conduct which created grave risk of death and physical injury to two people. According to the indictment, Smith knowingly and unlawfully possessed methamphetamine with the intent to traffick and operated a vehicle while under the influence of a controlled substance, while transporting a passenger under the age of 12 years old. Bond was set at $5,000 with the requirement Smith not operate a motor vehicle. Patrolman Austin Price (Harrodsburg Police Department) testified for the Commonwealth.
• Sean Smallwood, 49, of 696 Dardanelles Drive, Lexington, has been indicted for three class B felonies: 2nd degree assault, 1st degree strangulation and possession of a handgun by a convicted felon. Between the Aug. 8, 2023 and Aug. 12, 2023, in Mercer County, Smallwood is alleged to have caused serious physical injuries to the victim and to have intentionally and without consent pressed his victim’s throat, impeding her normally breathing. According to the indictment, Smallwood, who is being charged as a 1st degree persistent felony offender, was also knowingly and unlawfully on possession of a handgun after having been previously convicted of a felony. Bail was set at $20,000. Sgt. Richard Reilly (HPD) testified for the Commonwealth.
